He got a DUI because he was driving under the influence, not because of a trap. Let's not put the cart before the horse. ;)

No no trust me, it's definitely his fault and he deserves it for being a complete ass hole, I was simply suggesting that "trying to find a way around" isn't the greatest of ideas.
 
The Michigan Supreme Court had found sobriety roadblocks to be a violation of the Fourth Amendment. However, by a 6-3 decision in Michigan Dept. of State Police v. Sitz (1990), the United States Supreme Court found properly conducted sobriety checkpoints to be constitutional.

In the majority opinion, Chief Justice Rehnquist wrote, "In sum, the balance of the State's interest in preventing drunken driving, the extent to which this system can reasonably be said to advance that interest, and the degree of intrusion upon individual motorists who are briefly stopped, weighs in favor of the state program. We therefore hold that it is consistent with the Fourth Amendment."

Basically, if you are not drinking just do what they reasonably ask. If you have been drinking then you should go to jail.

The video is highly edited and very biased in favor of the kid. Who knows how many times that kid drove through that check point trying to get a reaction on video.

Not to mention if you truly don't want to answer up at a check point. Pull your inattentive head out. There is a alternate route or 'exit' to every check point. Just go around. Not to mention the half mile of signs and lights before hand...and media coverage and cops swarming around,... etc etc.


Didn't mean to swat the hornets nest here. Just stating my opinion.

People who do this crap are looking for a reaction.

People who say DUI check points remind them of Nazi Germany is pretty funny too....I doubt they were in Nazi Germany for starters.

If you can't understand why DUI checkpoints are set up at certain times of the year, I don't know what to tell you.

They aren't a secret. They are broadcasted. "Between these hours on this date, we will have DUI checkpoints. Don't drink and drive."

Then there's the guy who wants to prove he knows his rights, when he doesn't. He'll recite two sentences and then declare he's right and being illegally detained. When he's not. They are never attorneys. They are never LEO's. They don't have any POST qualifications. They've never been through the LEO process. They are just embarrassing themselves but want to record it, then edit it to show their buddies.

Then there's the, "I PAY YOUR SALERY," guy. The reality is, if you are in the highest tax bracket, you pay less than $0.25 a year. I'll be happy to toss you a quarter when I make contact with you. Obviously you need it more than I do and, it's funny.

Well...I was really hoping for it to be an advice to protect yourself thread.

I always give my patients advice on how to navigate the medical system, circumvent some of the expenses that physicians and hospitals push on patients, their rights as a patient to refuse test and push for less invasive procedures to diagnose and cure illnesses. Any lawyer will tell you to not speak when you are arrested because that will never help you and could only create more problems for you. Advice like that but maybe with more of a LEOs insight as well.

Like I said in the very first post, I have nothing but extreme respect for LEOs. They perform an often thankless job that most others refuse to do...but I am not going to lie and tell you that I'm not fearful of the power that their position has at their disposal to abuse. It's a very select few that do, but those that do have the law on their side and when it comes down to just the LEOs word vs a civilian's word...a judge will side with the LEO every time.

Strizzy not to throw gasoline onto a fire... but as a law enforcement officer for 8 years now for the military... in several different states as well as in Germany. Your advice is actually more of a trigger that some LEOs look for. Granted I will agree some LEOs take things to the extreme, but you statements more blanket to all LEOs....

Now Strizzy if I remember correctly I know your in the medical field. Please take a step back and think about this for a moment. Your dislike for a LEO to do their job, to attempt to get the drunk driver off the road so they don't kill anyone. Its just like if I said I don't like the medical field, because when I went under anastasia (cant spell it...) for surgery, that i felt that the doctor took advantage of me. Not in a sick and twisted way... but if I truely felt that the doctor, the surgeon, the nurse or EMT crossed the line, that I would be cautious to go to get a check up.
 
Not arguing here, just want to correct a misunderstanding/ miscommunication

Granted I will agree some LEOs take things to the extreme, but you statements more blanket to all LEOs....

I attempted on many posts to say that the abuse of power is very few...but those few that do abuse the power posses a frightening amount of power that others will give the benefit of the doubt over an alleged "criminal"

Again, I don't dislike a LEO doing their job, and actually applaud what they put up with on a daily basis. I thanked them last night when I performed a medical clearance for booking on 2 drunks racing at 100+ mph on the 101 while one vehicle had an unrestrained infant in the back car seat.

I am fearful that I'll have 1 beer with dinner and need to lie to an officer. Because I know that my patients that have "had a beer" or "just 2" usually means 7. Well I really only have 1 or I don't drive....but that's hard for me to believe in my patients and I know LEOs have a hard time believing it as well.

Its just like if I said I don't like the medical field, because when I went under anastasia (cant spell it...) for surgery, that i felt that the doctor took advantage of me. Not in a sick and twisted way... but if I truely felt that the doctor, the surgeon, the nurse or EMT crossed the line, that I would be cautious to go to get a check up.

If a medical professional is negligent or performs any form of malpractice to a patient....then it should be reported and investigated.
 
No i understand what your saying but trying to put it in perspective that it can bappen anywhere, but i wouldnt lie to a cop thats just a stupid thing to do... if you honestly had 1 beer, even if they pulled you out for a standardized field sobriety test, you would pass, even if they out you on a breathalyzer you would pass...
