Section 1 of the 14th Amendment deals with the citizenship of slaves. At the time questions were raised about their citizenship. Some people wanted to send them back to Africa- like Lincoln. Some people wanted to retain them for congressional apportionment- in other words count them for additional federal house seats for their state.
This amendment was never meant to be like a first down or touchdown in football where all ya gotta do is spike the ball past the line.
Section 1 Rights
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”The key part is: “and subject to the jurisdiction thereof,”
Individuals in the country illegally are NOT subject to the jurisdiction thereof.
Trump has a powerful constitution argument on this. Anybody who tells you differently has an agenda that is not in America’s best interest.
