Someone just tried to assassinate Trump

There has been a lot of talk about ‘Birthright Citizenship’ and much of the discussion contains misconceptions about Section 1 of the 14th Amendment and what it actually means.

A couple of pertinent points from the article.

‘THE JURISDICTION THEREOF.’​


Section 1 says:
“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside”


“They also correctly point out that the contention with the Wong Kim Ark decision is that it only applies to those residing legally in the United States and that birthright citizenship—as it is currently legally constituted—does not apply to the children of those in the country illegally. This is where Trump’s executive order would come into play, meaning he could end birthright citizenship on day one of his presidency for the children of illegal immigrants.”

The children of diplomats born in America do not become American Citizens.

Trump’s plan to reverse birthright citizenship only applies to the children of illegal aliens.

Good luck with that. There are many retirement age citizens who have lived here their entire lives and whose parents may or not have been here legally when they were born (and there is no way to know). Or one of the parents may have been here under a temporary family work visa when they were born. The notion of "illegal " did not even become a thing until the late 50s. Many residents of dubious status became naturalized citizens due to the Reagan administration. If a parent becomes a citizen after the children are born are the children still "illegal"?
