No collision insurance!😡

I was recently involved in collision. A man came into my lane and hit me in my jku. Messed up my smittybilt atlas front bumper, fenders, grill and hood. It would be nice to find a black hood so I do not have to do much paint work! It also bent my Dana 30 front axle and bent my adjustable track bar for a 3.5" lift and lower control arms. I did not have collision insurance and I am having a time with his insurance company . They are not wanting to pay. I just want it fixed so it's coming out of y pocket! Let me know if you have any of these things and $$$prices shipped to 28150!

Why are you having to deal with his insurance company? If he hit you and it was his fault, your insurance company should be going after them for you. That's what you pay them for.

I know it can be hard for you to deal with their insurance carrier. Sometimes, it is best just to file a small claims court action and show up with 2-3 estimates and then let the other person's insurance company explain why they should not pay. This places the insurance company at odds not only with the judge, many times with their our insured, who now has been sued and does not want to deal with the whole mess, which is why they paid for insurance in the first place. In small claims, they HAVE to show up.

Why are you having to deal with his insurance company? If he hit you and it was his fault, your insurance company should be going after them for you. That's what you pay them for.

This is incorrect. There is no "plaintiff's" insurance. Liability insurance is for when an insured becomes legal liable for an accident and the insurance company takes control of the claim to resolve the damages that are being claimed against the insured. If the OP had first party collision coverage, then they would have paid his damages less his deductible and then "subrogated" against the other carrier. The insurance company, in that case, would not be hiring any attorney's to "go after" anyone as this would likely be handled through intercompany arbitration. Without Collision coverage, the OP is on his own, unless the other party did not have insurance. Then maybe Uninsured Motorist Property Damage may apply.
 
The vehicles were moved before the cop got there. My first mistake was letting that happen. He does have liability insurance .I have a picture of his truck left of center on top of my jeep. When he jumped out he said it's my fault I have insurance it will cover it. When the cop arrived on scene he wasn't talking much and it was me telling the cop the story. He was a pretty shitty cop. It had been snowing out. He didn't even look at the vehicles and he said it was unable to determine. I call the other mans insurance next day and file a claim and give them my statement. They call the man who hit me and he try's to change the story. On top of that he didn't even try to file a claim on my insurance company. I have a lawyer and am in the process of taking him and the insurance company to court. But I am going to start repairing my jeep because it is the only vehicle I have to drive. I am borrowing one from my dad right now.

People are so crooked. Pisses me off. Hope you get it figured out.
 
I think you are on the only path that will get you a resolution... having your lawyer talk to their insurance company.

I have no affiliation with this company, but rubitrux usually has good deals with shipping on hoods that are all takeoffs.
 
The Officer should have come to some conclusion as to who was the at fault driver (Unit 1). Its not that often you cant tell who was the one at fault. I understand the vehicles were moved (as they should have been if possible) but with moderate to heavy damage there is going to be a debris field. Importantly the damage on the vehicles play a big role in role in determination (impact angle and paint transfer). Just saying. I was not there and don't know what was said but hopefully you were not victim to a lazy LEO.
